Terms & Conditions
1 Confirmation
Fylde requires all bookings to be confirmed in writing within 48 hours of being made for them to be guaranteed. Should written confirmation not be supplied, the booking may be released and the space sold to another client. Confirmation of a booking indicates the acceptance of these Terms and Conditions.
2 Deposit
Unless otherwise agreed in writing by Fylde, a deposit will be required on the signing of the contract booking, the amount calculated at 50% of the anticipated cost calculated in accordance with these Terms and Conditions. All deposits are non-refundable. Until payment of the deposit is received, no contract will have been deemed to have been entered into between Fylde and the Client.
3 Numbers
The maximum number of attendees at a function will be in accordance with the safety certificate. Prices quoted are based on the estimated number of guests attending the function provided by the Client. The guaranteed number of guests must be communicated to Fylde not less than seven working days prior to the event. The Client will be charged on the basis of the guaranteed number of guests or the number of persons for which the original event is originally booked if no guaranteed number is provided or the total number of guests attending, whichever is the greater.
4 Supervision
The Client will, during the period of the hiring, be responsible for supervision of the premises, the fabric and the contents; their care, safety from damage however slight; or change of any sort and the behaviour of all persons using the premises whatever their capacity.
5 Use of Premises
The Client shall not use the premises for any purpose other than that described in the hiring agreement and shall not sub-hire or use the premises or allow the premises to be used for any unlawful purpose or in any unlawful way nor do anything or bring onto the premises anything which may endanger the same or render invalid any insurance policies in respect thereof nor allow the consumption of alcohol thereon without written permission.
6 Gaming, Betting and Lotteries
The Client shall ensure that nothing is done on or in relation to the premises in contravention of the law relating to gaming, betting and lotteries.
7 Electrical Appliance Safety
The Client shall ensure that any electrical appliances brought by him to the premises and used there shall be safe and in good working order, and used in a safe manner. Where a residual circuit breaker is provided under terms of the PEL or CPL the Client must make use of it in the interests of public safety.
8 Indemnity
The Client shall indemnify the Committee for the cost of repair of any damage done to any part of the property including the curtilage thereof or the contents of the buildings which may occur during the period of the hiring as a result of the hiring.
9 Animals
The Client shall ensure that no animals (including birds) except guide dogs are brought onto the premises, other than for a special event agreed to by the Committee and no animals whatsoever are to enter the kitchen at any time.
10 Compliance With The Children Act
The Client shall ensure that any activities for children under eight years of age comply with the provisions of The Children Act of 1989 and that only fit and proper persons have access to the children.
11 Fly Posting
The Client shall not carry out or permit fly posting or any other form of unauthorised advertisements for any event taking place at the Club, and shall indemnify the Club accordingly against all action, claims and proceedings arising from any breach of this condition. Failure to observe this condition may lead to prosecution by the local authority.
12 Special Items
Fylde reserve the right to charge for the provision of special items in addition to any costs agreed between Fylde and the Client.
13 Menus
All details of the food to be served shall be set out on a separate menu, which will be agreed in writing. Fylde reserves the right to substitute alternative food of a similar quality if the items shown on the menu cannot be conveniently obtained. Any such changes will where practical be discussed with the Client. Fylde shall have no liability for any illness caused by an allergy that Fylde were not made aware of in writing prior to the event. Clients on the premises must comply with all licensing regulations. Consumption of food and drink other than that supplied by Fylde is not permitted without prior agreement.
14 Payment
The remaining payment of 50% must be made not less than 28 days prior to the Event the payment calculated on the basis of the anticipated costs for the guaranteed number of attendees or the number of persons for whom the Event was originally booked if no guaranteed number is provided. In the event of non-payment of the amount so calculated by the due date, Fylde reserves the right to treat the non-payment as repudiation of this contract. Final payment of any additional sums due from the Client is to be made within fourteen days of presentation of the final account. All drinks bills must be paid for in full on the day of the event. Fylde reserves the right to charge interest on unpaid accounts.
15 Value Added Tax
Unless where stated Value Added Tax at the current rate is payable on all charges.
16 Damages
The Client may not affix signs, displays or posters to the fabric of the venues without prior consent of Fylde. Any damage caused to equipment, décor, carpet, wall coverings either in the suites, public areas or to the exterior of the building, will be billed to the Client.
17 Clients’ Own Equipment
Fylde shall not be liable for any loss or damage to personal belongings in the venue, suites, public areas, car park, either during, prior to or after the event. The Client must ensure that any equipment brought to the venue complies with current Health and Safety Regulations.
18 External Noise
Fylde discourages any obtrusive external noise disturbance. However, should this occur and it is beyond the control of Fylde, Fylde will not be held responsible. Clients must ensure that noise levels at their functions are maintained at a level not to be obtrusive to the properties surrounding Fylde.
19 Fire Regulations
The Client will be briefed as to fire procedures. In accordance with that procedure the Client will be responsible for ensuring their guests respond in the proper manner.
20 Cancellation by the Client
The advance deposit will not be refunded in the event of cancellation of the event. In addition, a cancellation charge will be imposed and payable on demand in the event of the cancellation of all or any part of the Event after acceptance. The amounts are due as liquidated damages and not as a penalty and will be calculated in accordance with the following schedule:-

Additionally, any charges payable to any sub-contractor or any other costs, charges and expenses incurred on behalf of the Client will be charged.
21 Cancellation by Fylde
Fylde shall, upon giving not less than seven days notice in writing to the Client, have the right to cancel a booking if Fylde knows, or has good cause to believe, that such booking will lead to a breach of licensing conditions, if applicable, or other legal or statutory requirements. In the event of a cancellation under this clause the Management shall refund to the Client any deposit or booking fee already paid but shall not be liable for any other costs whatsoever incurred by either the Client or their Agent(s).
22 Unfit for Use
In the event of the Club or any part thereof being rendered unfit for the use for which it has been hired, the Club shall not be liable to the Client for any resulting loss or damage whatsoever.
